PARTIES TO DISPUTE:
(Burlington Northern Inc.
STATEMENT OF CLAIM: Claim of the American Train Dispatchers Association
that:
(a) The Burlington Northern, Inc. (hereinafter referred to as
"the Carrier"), violated the currently effective Agreement
between the parties, Article 21 thereof in particular,
when it failed and refused to properly compensate Claimant
Train Dispatcher G. N. Nadeau for private automobile
expenses incurred in connection with traveling from his
established headquarters to an outlying point to attend
an investigation on November
17, 1971
at the request of
the Carrier.
(b) Because of said violation, the Carrier shall now be
required to compensate Claimant G. N. Nadeau in the amount
of
$49.77
as reimbursement for said automobile mileage
expense.
OPINION OF BOARD: Based on the particular facts and circumstances of
this case the Board has concluded that the claim
should be sustained.
FINDINGS: The Third Division of the Adjustment Board, upon the whole
record and all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute
are respectively Carrier and Employes within the meaning of the Railway
Labor Act, as approved June 21,
1934;
That this Division of the Adjustment Board has jurisdiction
over the dispute involved herein; and
That the claim should be sustained.
