PARTIES TO DISPUTE:

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of
Railroad Signalmen on the Chicago and North Western
Transportation Company:
(a) The Carrier violated the current Signalmen's Agreement whet
on the close of the work day, September 12, 1972, the signal maintainers'
positions were abolished and in each instance a new position of Leader SiF
Mtnr. was established.
(b) The Carrier should now be required to re-establish the postion as separate signal maintainer pos
OPINION OF BOARD: Award 20630 involves these same parties and agreement
as well as an interpretation and application of Rule
20(a). Following that award and the doctrine which precludes considerati,
of moot questions or abstract propositions or the affirmation of principl~
which do not affect the matter in issue,we must deny the claim.
FINDINGS: The Third Division of the Adjustment Board, upon the whole reco-
and all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and Employes within the meaning of the Railway Labor
Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction ovethe dispute involved herein; and
That the Agreement was not violated.
