STATEMENT OF CLAIM: Claim of the General Committee of the
Brotherhood
of Railroad Signalmen on the Chicago and North
Western Transportation Company:
(a) On May 20, 1973 the Carrier violated the current Signalmen's Agreement particular rule 16(a)
assigned Ldr. Sig. Mtnr. at Lake Bluff, I11. for signal trouble at Dunes
Park.
(b) Carrier now be required to compensate Mr. Hodge for 2
hours and 40 minutes (a call) for the above violation. fc-arrier's File:

OPINION OF BOARD: The employees have failed to support their burden
of proof in this case. We find no violation of
the Agreement. Therefore, we will deny the claim.
FINDINGS: The Third Division of the Adjustment Board, upon the whole
record and all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and Employes within the meaning of the Railway Labor
Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction
over the dispute involved hereins and
That the Agreement was not violated. '
