PARTIES TO DISPUTE:
(Seaboard Coast Line Railroad Company
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood
(GL-7758) that:
(1) Carrier violated the Agreement between the parties November
4,
1973, when it permitted or required train service employees to perform duties which for many yea
been performed by agency forces at Sanford, North Carolina.
(2) Carrier shall be required to compensate Agent W. P. Cox
one call three (3) hours at time and one-half the pro rata rate November
4,
1973, for the violation aforesaid.
OPINION OF HOARD: The facts and circumstances presented in this claim
are similar in all material respects to those found
in Award 20938 and it moat be denied for the reasons expressed in that
Award.
FINDINGS:. The Thiid Division of the Adjustment Hoard, upon the whole
record ahd all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute
are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June
That this Division of the Adjustment Hoard has jurisdiction
over the dispute involved herein; and
That toe Carrier did not violate.the Agreement.
