STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railroad Signalmen o
On behalf of Signal Maintainers C. C. Catron and R. Stanley, headquarters
Watseka, Illinois, for additional compensation at one-half the straight time
hourly rate, in addition to their monthly rates, pursuant to Rule 70(c) as
amended by a Memorandum Agreement signed June 28, 1973, for time worked off
their assigned territory, beeinning August 12, 1974, and continuing. (Initial
claim letter of September 16, 1974, listed specific dates, showing a total of
114 hours each, August 12 thru 30, 1974. Appeal letters of September 16 and
November 11, 1974, also listed specific dates and showed a total of 240 hours
for Mr. Stanley, and 320 hours for Mr. Catron, August 12 thru October 8, 1974.

OPINION OF BOARD: The record discloses a dispute between the parties as to
essential facts and there is nothing in the record upon
which this Board can act. Therefore, the claim is dismissed.
FINDINGS: The Third Division of the Adjustment Board, upon the whole record
and all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and Employes within the meaning of the Railway Labor
Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over
the dispute. involved herein; and
That the Claim be dismissed.
