STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood
of Railroad Signalmen on the Southern Railway
Company et al.:
On behalf of T. R. Riley, Signal Maintainer, Slidell, La., for
sixteen (16) hours at his overtime rate as Signal Maintainer account
Carrier instructing Electrician Bill White, headquarters New Orleans, La.,
and Don Feltman, headquarters Meridian, Miss., to load and haul signal
material to Tuscaloosa, Ala., on March 11, 1975, to be used by signal
employees. Signalmen used wire to repair signal circuits south of
Tuscaloosa, Ala., on March 12, 1975. LCarrier's file SG-112/
OPINION OF BOARD: For the reasons set forth in our Award 21635 and with
particular reference to Third Division Awards 10613
and 12188, we deny the claim.
FINDINGS: The Third Division of the Adjustment Board upon the whole
record and all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and Employes within the meaning of the Railway Labor
Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over
the dispute involved herein; and
That the Agreement was not violated.
