STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood of
Railroad Signalmen on the Atlanta and West Point
Railroad Company, The Western Railway of Alabama, Georgia Railroad:
On behalf of Telephone-Telegraph Maintainer F. L. Thigpen and
Assistant Telephone-Telegraph Maintainer N. L. Johnson, headquarters
Atlanta, Georgia, for eight (8) hours straight time on February 24, 1977,
and ten (10) hours straight time on March 7, 1977, account Signalmen
J. L. Yancey and S. H. Glover were instructed and permitted to perform
duties assigned to Claimants by bulletin and the present Agreement when
they removed telephone wires and crossarms between Mayson Avenue and
Atlanta Yard."
OPINION OF BOARD: This is a companion claim to one filed by the
Organization on behalf of Signalman J. L. Yancey
and S. H. Glover, the individuals who performed the work for which the
Claimants in this case seek compensation.
In that case, the Board issued Award No. 22652 in which it was
found that the agreement had been violated and the claim was allowed.
This Board reaffirms the opinions and findings contained in

FINDINGS: The Third Division of the Adjustment Board, upon the whole
record and all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute are
respectively Carrier and Employes within the meaning of the Railway Labor
Act, as approved June 21, 1934;

That this Division of the Adjustment Board has jurisdiction
over the dispute involved herein; and
That the Agreement was violated.
