PARTIES TO DISPUTE:
(The Baltimore and Ohio Railroad Company
STATEMENT OF CLAIM: "They're working men in my place since 1957
by the name of RICHARD - Ralph Patrons"
OPINION OF BOARD: The record is clear that the claim that Petitioner
is attempting to assert before this Board has not
been handled on the property up to and including the Chief Operating
Officer of the Carrier designated to handle such disputes as required
by Section 3, First (i) of the Railway Labor Act, Circular No. 1 of
the National Railroad Adjustment Board, and the rules of the applicable
collective bargaining Agreement. The claim is, therefore, not properly
before-the Board and must be dismissed.
FINDINGS: The Third Division of the Adjustment Board, upon the whole
record and all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute
are respectively Carrier and Employes within the meaning of the
Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction
aver the dispute involved herein; and
That the claim be dismissed.
