OPI:IT_0N OF BOARD: Claimant, Signal Maintainer B. R. Dishman, presented time
claim on his second period August semi-monthly time roll for three (3) hours overtime rate for August 21, 1900 because "other than signal forces disconnected the track bond wire while changing a piece of rail". o Novemner 19, 1980.
n N

After a review of the record before it, it is the Board's determinination that Rule 60 (a) of the current AEreement was contravened by the Organization when it did not file grievance pertinent part, that all claims or grievances must be presented To Carrier within sixty (60) days from the date of the occurrence on which the claim or grievance is based. It is clear from the record before the Board that the November 19, 1980 filing date surpassed this contractually mandated time-limit, thus barring any decision on the merits of the instant case.

FINDINGS: The Third Division of the Adjustment Board., after giving the
parties to this dispute due notice of hearing thereon, and
upon the whole record and all the evidence, finds and holds:

That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning ox' the :~ailway Labor Act, as approved June 21, 1934;
