OPINION OF BOARD: The merits of the instant case depend a fortiori on the
jurisdictional correctness of organization claim, already
heard before the Board in Award No.
24454p
wherein Organization requests
Board decision on the validity of Agreements signed by the parties to that
case.
In that case by reference, as in this, the Board interlines that it
has no jurisdiction herein to resolve issue at bar since the claim addresses
the validity and not the interpretation of contracts. National Railroad
Adjustment Board Awards and Supreme Court decisions cited in Award No.
24454
herein equally hold.
FINDINGS: The Third Division of the Adjustment Boards after giving. the
parties to this dispute due notice of hearing thereon., and upon
the whole record and. all the evidence, finds and holds:
That the Carrier and the Faployes involved in this dispute are
respectively Carrier and Employee within the meaning of the Railway Labor
Act, as approved June
21, 1934;
That this Division of the Adjustment Board has jurisdiction over
the dispute involved herein; and
That claim is barred.
