STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railroad
Signalmen on the Consolidated Rail Corporation.
System Docket 1938-C, Southern Region
(a) Carrier violated the current Signalmen's Agreement, particularly
Appendix "P", by sending Assistant Supervisor C&S M. Todd to make repairs on the
switch at the east end of Clement on June 25, 1982.
(b) Carrier should now be required to compensate Maintainer T. L.
Hedges three (3) hours' pay at the time and one half rate.
OPINION OF BOARD: This dispute arose after the Organization contended that the
Carrier "...required and/or permitted an official not
classified in or covered by..." the parties' agreement to make repairs on a switch.
The record, in this case, shows that a Carrier official made an inspection
of the involved track switch. The contention stated in the claim that this official
made "repairs" to the switch is not supported by the record. Accordingly, the
claim must fail.
FINDINGS: The Third Division of the Adjustment Board, upon the whole record and
all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the F3nployes involved in this dispute are
respectively Carrier and &mployes within the meaning of the Railway Labor Act, as
approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein; and
That the Agreement was not violated.
