STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railroad
Signalmen on Consolidated Rail Corporation:
That Signal Maintainer J. Brodeur be restored to service of the Carrier
with all rights and benefits unimpaired and be compensated for all lost wages from
the date of his suspension and subsequent dismissal. (Carrier file No. SD-2051-D)
OPINION OF BOARD: This is a companion to Award 25426. The facts are identical
and set forth in that Award, together with our decision.
FINDINGS: The Third Division of the Adjustment Board, upon the whole record and
all the evidence, finds and holds:
That the parties waived oral hearing;
That the Carrier and the Employes involved in this dispute are respectively
Carrier and Employes within the meaning of the Railway Labor Act, as approved
June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein; and
That the Agreement was not violated.
