STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that:

1. The dismissal of Extra Gang Laborer C. E. Williams for alleged violation of 'General Notice, General Rule B and General Regulations 700 and 702(c)' was without just and sufficient cause (System File 5-18-12-14-55/ 013-210W).

2. The claimant shall be reinstated with seniority and all other rights umimpaired and he shall be compensated for all wage loss suffered."

OPINION OF BOARD: The Claimant herein was a short-term employe, with about
one and one-half years of service. Based on the record
before the Board, there is no proper basis for the Board to interfere with the
discipline imposed by the Carrier.

FINDINGS: The Third Division of the Adjustment Board, after giving the parties
to this dispute due notice of hearing thereon, and upon the whole
record and all the evidence, finds and holds:

That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June 21, 1934;

That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and

        That the Agreement was not violated.
