The Third Division of the Adjustment Board upon the whole record and all the evidence, finds that:

The carrier or carriers and the employe or employees involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.



Claimant was employed by Carrier as a Train Dispatcher at Gibson, Indiana. On March 19, 1984, Claimant was alleged to have been responsible for unnecessarily delaying a train for two hours during which the Hours of Service Act caught the crew and a new crew had to be called to move the train over the Indiana Belt tracks to the ICG property. For this alleged infraction, Claimant was assessed a 10-day
The Board has reviewed the record and can find no basis on which to modify or overturn Carrier's actions in this case.
