(The Atchison, Topeka and Santa Fe Railway Company

STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood


(a) Carrier violated the current Clerks' Agreement at Topeka, Kansas, when it wrongfully held a 24-H Hearing and further reduced Claimant's pay for time lost while attending 24-H Hearing on September 20, 1985, and

(b) Claimant Giudicessi shall now be compensated $6.35 which was deducted from his last half September, 1985 paycheck for time lost attending the 24-H informal investigation, and

(c) Upon expiration of 60 days from the original date of submission, Carrier shall also pay the claimed."

FINDINGS:

The Third Division of the Adjustment Board upon the whole record and all the evidence, finds that:

The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.



Claimant reauested a Rule 24-H Hearing (an unjust treatment conference). Carrier objected to con time, the Hearing was held. The Hearing lasted about 25 minutes. Claimant's pay was deducted for the time he spent at the Hearing. He subseauently filed the instant Claim, reauesting return of $6.35 deducted from his pay for time spent at the Hearing.

This Board has reviewed the record and can find no rule support for
Claimant's position. We therefore deny the Claim.
