PARTIES TO DISPUTE:
(Northeast Illinois Regional Commuter Railroad Corporation
STATEMENT OF CLAIM: "Claim of the General Committee, Brotherhood of Railroad
Signalmen, on the Northeast Illinois Railroad Corporation,
that:
(a) Carrier violated the current N.I.R.C. Agreement, especially
Rules ##15 and #117, when the Carrier failed to call Mr. Bill Young for overtime
service on Sunday, May 22, 1988.
(b) Carrier is now required to compensate Mr. Young 12 and 3/4 hours
at his current punitive rate of pay." Carrier file 11-27-77.
FINDINGS:
The Third Division of the Adjustment Board upon the whole record
and all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this
dispute are respectively carrier and employes within the meaning of the
Railway Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the
dispute involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
On Sunday, May 22, 1988, Carrier called a junior employee to perform
overtime work. Carrier states that the Signal Foreman attempted to call the
Claimant but did not have his telephone number.
Claimant asserts that he was hoiue and available for work and his
phone number is listed in the local directory.
Claimant, and others, have supplied their addresses and phone numbers
to the Carrier as required.
It is apparent from the correspondence of record that Carrier instructed the Foreman to call Cla
employees' telephone numbers.

Carrier did not make a reasonable effort to contact the Claimant.
