The Dissent would have one believe the "facts" were not in
dispute. Such assertion, however, is sorely tried when one
observes the 45 page document submitted by the Organization
setting forth its version of the facts, the nine page document
submitted by the Carrier setting forth a totally different
version of the facts, and the nine page Submission of the
interested third party disputing the organization's factual
assertions.
The Dissent's anguish is not justified. All the Majority
held was that the Organization filing a dispute with the Board
had the obligation to present a clear factual situation so the
Board would be in a position to analyze the Agreement in the
context of the facts presented. The Dissent appears to suggest
that the Board is asking for too much.
