PARTIES TO DISPUTE:


STATEMENT OF CLAIM:

    "Claim on behalf of the General Committee of the Brotherhood of Railroad Signalmen on the Chicago & North Western Transportation Company (CNVV):


    Claim on behalf of R.E. Stipek for payment of $40.00 and M.J. McNace for payment of $20.00, account Carrier violated the current Signalmen's Agreement, particularly Rules 30, 56 and 58, as well as the established practice of reimbursing employees for the cost of special licenses, when it refused to reimburse the Claimants for the total expenses incurred in obtaining Commercial Drivers Licenses required for their positions. Carrier's File No. 79-92-41. General Chairman's File No. SAV-108. BR$ File Case No. 9077-


FINDINGS:

The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employee or employees involved in this dispute are respectively carrier and employee within the meaning of the Railway Labor Act, as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

    Parties to said dispute were given due notice of hearing thereon.

This claim concerns a dispute as to fee payment for a Commercial Driver's License, which the Claimants were required to obtain.


This identical subject is covered in Third Division Award 31156 involving the same parties and seven Claimants. Having reviewed this Award, the Board concurs with its reasoning and conclusion. There is no Rule support obligating the Carrier to reimburse the Claimants for this fee.


                        AWARD


    Claim denied.


                        ORDER


This Board, after consideration of the dispute identified above, hereby orders that an award favorable to the Claimant(s) not be made.
