FINDINGS:

The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employee or employees involved in this dispute are respectively carrier and employee within the meaning of the Railway Labor Act, as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.




This dispute concerns an aspect of the Carrier's utilization of a contractor to unload concrete cross ties. The aspect at issue is confined to whether or not the Carrier is required to assign a Special Equipment Operator to assist. The Carrier did assign a Foreman and Trackmen.


This identical issue, involving the same parties, was reviewed by the Board in Third Division Award 31615. The Board finds the reasoning therein to be sound and has no basis to reach a different conclusion.






This Board, after consideration of the dispute identified above, hereby orders that an award favorable to the Claimant(s) not be made.
