STATEMENT OF CLAIM:

that:

(Springfield Terminal Railway Company

"Claim of the System Committee of the Organization (GL-11700)

This claim is on behalf of Ms. Donna Coppolino, Clerk, Transportation Services, North Billerica, Massachusetts. Claim is for the difference in pay of $13.17 which Ms. Coppolino is currently making and $15.30 which is the Springfield Terminal rate.


Carrier violated the Agreement when it moved the clerical work from Woodland, Maine and added this clerical work to the position currently held by Ms. Coppolino at North Billerica, Massachusetts. This was done without an Agreement, notification of Coppolino and no notification of the Union (TCU) or its Duly Accredited Representative. Claim commences October 13, 1995, and for each day until corrected.


Rules violated are: 1, 15, 16, 12, 14, 51 and the Stabilization Agreement of 1965, which was amended on October 17, 1984."


FINDINGS:

The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employee or employees involved in this dispute are respectively carrier and employee within the meaning of the Railway Labor Act, as approved June 21, 1934.

Claimant is a Clerk in Transportation Service at North Billerica, Massachusetts. Claimant seeks additional pay (the difference between $15.30 per hour and $13.17 per hour) for each workday commencing on October 13, 1995 and continuing for each day thereafter. In summary, the Organization charges that the Carrier transferred duties of an abolished position to Claimant's position.


This Board carefully perused the record and we do not find any explanation of the type of work involved. More specifically, the Organization has not described what duties of an abolished position were purportedly transferred to Claimant's position. The claim is denied for lack of proof.


AWARD

Claim denied.

ORDER

This Board, after consideration of the dispute identified above, hereby orders that an Award favorable to the Claimants) not be made.
