This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

The Claimant was disciplined for failure to report for work at the designated time and place on July 5, 2005, at Heavener, Oklahoma. At the time of the incident, the Claimant had some six years of service.

Our review of the unique facts involved in this record compels us to find it to be lacking in substantial evidence to support the Carrier's action. Accordingly, the claim must be sustained.

This Board, after consideration of the dispute identified above, hereby orders that an award favorable to the Claimant(s) be made. The Carrier is ordered to make the Award effective on or before 30 days following the postmark date the Award is transmitted to the parties.
