STATEMENT OF CLAIM:

"Claim on behalf of the General Committee of the Brotherhood of Railroad Signalmen on the CSX Transportation (formerly Louisville & Nashville):

ClaimonbehalfofE.N.Cole,III,for$610.65;accountCarrierviolatedthe current Signalmen's Agreement, particularly Rule 29, CSXT Labor Agreement No. 15-093-98, when, on June 9[14] and 23[28], 2015, NS July 12, 2015, it refused to compensate the Claimants the mileage he traveled inhispersonalvehicleafterbeingrequiredtomovetoadifferentreporting location during the workweek. Carrier's File No. 2015-192311. General Chairman's File No. 15-208-01A. BRS File Case No. 15472-L&N."

FINDINGS:

The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employee or employees involved in this dispute are respectively carrier and employee within the meaning of the Railway Labor Act, as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

Parties to said dispute were given due notice of hearing thereon. Form 1 Page 2

Award No. 43787 Docket No. SG-43986 19-3-NRAB-00003-170040 This is a claim for reimbursement of travel expenses associated with the Claimant's being required to move to a different reporting location during his workweek, pursuant to Rule 29 of the Signalmen's Agreement and CSXT Labor Agreement No. 15-093-98.

A review of the Carrier's records confirmed that the Claimant was in fact paid. Accordingly, the Board will dismiss the case.

AWARD

Claim dismissed.

ORDER

This Board, after consideration of the dispute identified above, hereby orders that an Award favorable to the Claimant(s) not be made.
