Review Board No. 3 relied on our decision in Oregon Shoe? Line whom It Imposed employee protective conditions In this care. In Oregon Shore Line we found that the arrangement for the protection of employee negotiated between the National Railroad passenger Corporation end various railway employee representatives end approved by the Secretary of Labor on April 17. 1971 (commonly kilows as the Appendix C-1 conditions). was the arrangement established purnam to section 103 of the Rail IssisrUnger Service Act upon which we should base future employee prorcction under section Ief11 of the set. Since the operative language of Mellon 5(2x1) b almost Identical to that of rcelion Ie(I),1 we believe the rcvkw board scud properly in imposing the employee protective conditions snunelmed In Oregon Then Line in this cost. Thus, out reasoning fn Oregon Short Line supports the review board's decision.

Before proceeding wish our discussion of the contentions'pf the persist we should indicate that certain modifications have been made in the conditions adopted in Oregon Shore Line by our moo retest upon end order in that proceeding m 731 LC.C. 311 (19111. Far the reasons set forth in that report. we shall also modify the employee protective conditions imposed in this cam in the nine

Petitioner claims that the Appendix C.I cnndilinna arc less protective of the inlereMS of employees Than the conditions pnvleusly Imposed punuent in section 31211r1. II Claims those eoedhlona aro InwfOcienl In this can because Ihcy contain no provWona equlvelenl to sections 1 end 3 of the Washington Job Protection Agreement: petitioner titer Sourhern Ry.-~'onrrolCtnMl of Georgia Ry. We do not believe section 3(7110 of the act requires us to impost seetbp I end 3 of the Washington Agreement in this proceeding or In other ordinary Inctege rights proceedings. P<litinner's argument for Imposition attach protection h hoed upon that pan of amended section 3(2xA which requires protection equal to the protection Impaled pursuant to that section prior to its amendment by the IR Act. We mum determine whet the standard of protection was under old lattice 3axn.

11 the peel the Commission Imposed different employee protective conditions In different types of section 3171 cases. For eVmple, the Oklahoma condition were ordinarily impose) in trackage rights cafes end the New Orlronr' conditions, with modifications as were necessary. were frequently imposed in mer/ef-ennlrnl·lypt cams. The Oklahoma conditions which had beep and in trackage rights cows do not contain protection equivalent to nations I end 3 of the Washington Agreement.

Congress wet aware of the fact that different employee protective conditions had been used in different types of transactions when it passed the IR Act. The IR Act does not indicate any disapproval of the fact that different protective condition had been used in dBfercrl asses. Since the CommiMinn, did not impose sections I and 3 of the Washington Agreement In trackage rights cash in the past. me failure to Impose those sections in this cue cannel now (under Ik IR Act) be considered inappropriate. The resulting arrangement h Not lam protective of the Interest of employees than the

Nothing In Southern Ry.--Control--Cewfnl a/Gtsrll4 slrpns. Is to the contrary. Thai um was a eoatrol proeeadlp where a reduction is force was conlcmplmed, and a eouolWalloa of sealority rosters would be required. No consolidation of forces 4 required la ordinary tracings rights cases. There V no aced for sections s and S of the Washington Agreement to be Imposed is them.

N·W proposes its owe set of conditions consisting of the Olth<hems conditions with IM addition of certain provisions from the Appendix C-1 conditions. In support of Its contention that the conditions it proposes would provide a proper standard of protection, N·W Incorporates by reference a portion of the American Association of Railroads "Comments of The Association of American Railroads Upon Proposed Conditions for Protection of Employees" (AAR Comments). Thom comments were invited by the report on reconsideration in No. AB-76 (Sub-No. 7). Oregon Short Line, PRIM

MRS basic argument is that Congress did not intend to have the Commimioe cheap ire employee protective policy to a significant extent and that adopting the Appendix C-1 conditions b contrary td that congressional Intent. TM AAR comments then go on to address IM further protection that it believes the amendment to anion xixn requires. We arcs wish applicant that the equmem of the American Association of Railroads, even though Y Is addressed to the proper employee protective srcnderds in abandonment proceedings. is relevant to this use. However, we believe those elsarcntbns arc adequately addressed in the latest report in Oregon Shen Line. We re no need to address them here.

For the reasons set forth about and in our latest report in Orepa Share Line, we find that the petition for administrative review and the modifications proposed by the applicant should be denied.

If U ordered:
(I) The petition for administrative review is denied.
(2) The modifications proposed by epplicent art denied.
