QUESTION Application of ARTICLE III - IMPLEMENTING AGREE28NTS -
AT ISSUE: whether the employees may refuse to enter into an imple
menting agreement, thereby restricting the Carrier from
making an operational change.
OPINION Section 1 of Article III of the Mediation Agreement dated
OF BOARD: February 7, 1965, requires a signatory organization to
enter into an implementing agreement with the carrier
under the terms and conditions contained in the aforesaid Mediation
Agreement.
AWARD
The answer to the question submitted is that the organization may not refuse to enter into an implementing agreement not inconsistent
with the provisions of the Mediation Agreement of February 7, 1965.
