QUESTION
AT ISSUE: Whether Section Foreman W. W. Wolverton,
Sterling Zone, f.icCaa]k Division, is entitled
to reimbursement for meals, expense and
mileage while working at Carpenter, Wyoming,
between February 28 and march 31, 1966.
OPINION f-tr. Wolverton, a protected employee, had keen
OF BOARD: displaced as Section Foreman and he was regularly
employed as a Laborer ac venan,o, Nebraska, when
he relieved a Section Foreman at Carpenter, Wyoming,
for 33 days. The record discloses that Carrier advised Claimant
of the vacancy. It does not support the Employes' assertion
that Carrier directed Claimant to fill it. Carrier maintains
that Claimant acted to protect his. seniority as a Foreman.

In connection with protected employees being used for temporary assignments, Article II, Section 3, provides that "traveling expenses will be paid in instances where they are allowed under existing rules." The rules provide that traveling expenses will not be paid to employees in the exercise of seniority, but only when they are incurred at the direction of management.

Since the Employes have not established that Claimant was directed by management to fill the vacancy at Carpenter, Wyoming, the claim must be denied.



          The answer to the Question is "No."
