QUESTIONS (1) Whether or not the Carrier may suspend a protected
AT ISSUE: employee's guarantee, or offset against it, during any
period in which he occupies a position not subject to
the working agreement pursuant to Article IV, Section 5.
(2) Whether or not claims prior to January, 1970, are
barred, not having been progressed under applicable
time limits.
OPINION Under the prevailing awards of this Board, we are precluded
OF BOARD: from considering the mertis of this dispute by reason of
the fact that the organization has failed to comply with
the mandatory procedural requirements. Award Nos. 131, 299 and 310.

                          AWARD


1. The question as presented by Carrier cannot be considered and is therefore dismissed.

2. The answer to Question No. 2 as set forth by Carrier is that the claims are barred.
