STATEMENT OF CLAIM:

1. The Carrier violated the Agreement when it assigned outside forces (Roki's Repair Shop) to perform work equipment repairmen work of Carrier's vehicle maintenance and repair work beginning on March 8, 2010 and continuing.

2. As a consequence of the violation referred to in Part (1) above, Work Equipment Repairman C. Pantermoller shall be compensated for all hours expended by the outside forces in the performance of vehicle maintenance and repair work. (Carrier File MW-10-06)

The Board, after hearing upon the whole record and all the evidence, finds that the parties herein are Carrier and Employee within the meaning of the Railway Labor Act, as amended; this Board has jurisdiction over the dispute involved herein; and, the parties were given due notice of hearing thereon.

During Board hearings on this case, the parties jointly requested that the claim be withdrawn without prejudice to the Organization retaining the right to advance a claim of like nature in the future should it so elect to do so.
