STATEMENT OF
CLAIM: Claim
that former Illinois Division Miscellaneous
Machine
perator R. J. Fisher be reinstated with seniority, vacation,
all benefit ri$hts, pay for wage loss and/or otherwise made whole,
account unjustly removed from service for, using Gelco-Santa Fe credit
card for his personal use.
FINDINGS:
This Public Law
Board No. 1582 finds that the parties
ere n are Carrier and Employee within the meaning of the Railway
Labor Act, as amended,
and
that this Board has jurisdiction.
Ia this dispute the claimant was discharged for using a Gelco-Santa
he credit card for his personal use.
The Board has carefully examined the transcript of record, and although the evidences indicates there may not have been an intent on
the part of the claimant to wrongfully use the Company credit card,
nevertheless he did improperly use the Santa Fe credit card for his
personal use.
Under the 'rules then Carrier has the right to issue serious
discipline
for such an offense. The Board does not have the authority to overrule the decision of the Carrier under these circumstances.
AWARD: Claim denied.
