 _F-"DINGS: This Public Law Board No. 1582 finds that the parties
 :arein are Carrier and Employee within, the meaning of the Railr?ay
 T-'Dor Act, as amended, and that this Board has jurisdiction.

 I-i this dispute the claimant was charged with possible violation of '; ~'i.~::~ 3 and 16. On December 23, 1974 claimant was notified by cer-. i:_:.=ied mail to attend a formal investigation but the letter was re;:=ad unclaimed. The letter was addressed to the claimant's last '_nown address listed by the claimant with the Carrier. Pursuant 'to the investigation, the claimant was found guilty of absenting himsolf from duty without authority commencing December 13, 1974 and uas discharged from the service of the Carrier for his responsibility _.- connoction therewith.

 ?R-n-ently the clamant was not too interested in returning to vorl: ._~t:1a Carrier for he did not appear at the investigation. Under i:::~ circumstances the Board finds no justification to overule the Cscision of the Carrier.
