 STATEMENT 1. Carrier violated the Rules Agreement effective
 OF
 CLAIM: April 15, 1944, as amended when on March 31, 1977,
 between 7 a.m.,and 11:30 p.m. Foreman Joel Myron
 performed a Trackman's duties of gauging and re
 placing ties at Gates Avenue, Jersey City, New
 Jersey and at Transfer Oak Island, Newark, New
 Jersey.
 2. As a result of such violation, Claimant A.
 McNeil be compensated one day's pay at the Track
 man rate.
 FINDINGS: For the reasons mentioned in Award No. 24, which
 concerned the same basic issue, contentions and
 rules, this claim will be denied.

AWARD.: Claim denied.
