 Dispute The Baltimore and Ohio Railroad Company
 Statement Claim on behalf of Jerry A. Sprout and Sam Ferrise for a total
 of of twenty-one (21) days to be equally divided from February 7,
 Claim 1978 to March 31, 1978, account various employees named in
 the claim working on Claimants' prior rights territory while
 they were both furloughed.

Upon the whole record and all the evidence, after hearing, the Board finds that the parties herein are carrier and employee within the meaning of the Railway Labor Act, as amended, and this Board is duly constituted by agreement under Public Law 89-456 and has jurisdiction of the parties and subject matter.


It has been agreed that this Award is without prejudice to the position of either party.
