STATEMENT Carpenter Jackie T. Christian's dismissal was un
CLX-IM: just and he should be given the remedy of Rule 48
(e) including his loss of health and welfare bene
fits.
FINDINGS:
Upon the whole record and all the evidence, after hearing, the Board finds
that the parties herein are carrier and employee within the meaning of the
Railway Labor Act, as amended, and this Board is duly constituted by agreement
under Public Law 89-456 and has jurisdiction of the parties and subject matter.
In these circumstances, claimant will be given one
more opportunity to demonstrate that he can be relied on for steady,
service.
This award is not to constitute a precedent.
AWARD: Claimant reinstated. with seniority unimpaired but
without back pay. To be effective within 30 days.
