Case No. 107 Award No. 106

PARTIES Brotherhood of Maintenance of Way Employes
to -and-
DISPUTE: Consolidated Rail. Corporation

STATEMENT OF CLAIM: Appeal of Casual Driver, R. J. Robak, to have a ten-day suspension removed from his record.

FINDINGS: The Claimant herein was charged with unauthorized absences on various days in January and February 1985. Subsequent to a hearing held on March 15, 1985, he was found guilty of the charge and was assessed a ten-day suspension.
The evidence supports the Carrier's determination that the Claimant had absented himself without proper authorization. Given this finding and in recognition of the fact that the Claimant had been previously warned about his absenteeism, it cannot be said that the ten-day suspension was unduly harsh.

AWARD

The claim is denied.
