PARTIES Brotherhood of Maintenance of Way Employes
DISPUTE: and
Consolidated Rail Corporation
STATEMENT Appeal by Vehicle Operator Oscar McKenzie from
CLAIM: suspension for alleged misuse of credit card on
November 8, 1982.
FINDINGS: Claimant, a bus driver with 10 years service, was
suspended for six months for unauthorized use of
a Conrail credit card to purchase gasoline for his
own personal use.
It is understandable that the control and misuse
of credit cards are matters of considerable concern to Carrier. These
cards are entrusted to employes strictly for use on Company business.
Misuse on the broad farflung scale embraced by the railroad is ex
tremely costly.
In the present case, claimant obtained gas for a
Company bus and for a private motor vehicle on the same day. Confusion
may have resulted but there is credible evidence that supports Car
rier's finding that its credit card entrusted to claimant was used for
PLB No. 3514 Award No. 11 Case No. 12 z

the purpose of obtaining gas for a private vehicle. That evidence, though controverted, is sufficient to support the charges. We find no basis for substituting our judgment for that of Carrier.

AWARD: Claim denied.
