 STATEMENT OF CLAIM:

          Appeal of Trackman Eugene Szczygiel to have his discipline of dismissal removed from his record and to be restored to the service.


FINDINGS: Subsequent to a hearing held on August 26, 1985, the Claimant was found guilty of charges mainly related to his consumption of alcoholic beverages prior to reporting for duty.
 A review of the transcript of the trial shows that it was conducted in a fair and impartial manner and that the Claimant was present throughout and was represented. Without detailing the evidence, a review of the transcript establishes by substantial evidence that the Claimant was guilty as charged. There is no proper basis for the Board to interfere with the discipline imposed.

                          AWARD


      The claim is denied.
