STATEMENT OF CLAIM:
Appeal of Vehicle operator, William E. Fitts, to
have his discipline of ten days suspension and disqualification as a Vehicle Operator removed from
his record.
FINDINGS: This dispute arose subsequent to a determination by the
Carrier that the Claimant failed to follow the instructions of
his supervisors, resulting in serious damage to a Conrail vehicle.
We have closely reviewed the transcript of the hearing con-
ducted in this matter and find evidence that the Claimant was guilty
of the charge. However, given the time that has elapsed since the
incident occurred and in recognition of the Claimant's length of
service, we are satisfied from our examination of the pertinent
facts that he should be afforded another opportunity to serve as a -
Vehicle Operator, subject to satisfactorily meeting carrier's -
requirements.
AWARD
The Award is as specified above. The disqualification will
be removed within thirty (30) days of the date of this Award.
However, no back pay will be due the C:-iimant.
