DISPUTE:
STATEMENT OF CLAIM: That B&B Mechanic B. Colon was unjustly
suspended for 60 days, that this suspension be stricken from his
record, and that he be compensated for all lost time while out of
the service.
FINDINGS: This dispute arose after the Carrier found the Claimant
guilty of a charge that he had filed a false report regarding a
personal injury sustained by him on June 23, 1981.
The record supports the Carrier's determination since the
Claimant admitted making an original false statement as to what
caused his injury. Accordingly, while the Board recognizes the
Foreman's role in the events leading to the false report, the
Claimant clearly erred. Given the importance of the controlling
rules in this dispute, the discipline imposed was not unreasonable
under the circumstances herein.
AWARD
The claim is denied.
