DISPUTE: Consolidated Rail Corporation
STATEMENT OF CLAIM: Appeal of Welder, J. J. Hedrick, to have
his discipline of dismissal removed from his record and to be
restored to the service.
FINDINGS: The Claimant was notified to attend an investigation
on a charge that he purchased items by the use of a Carrier order
form and then used these items for personal gain. Subsequent to
the investigation, the Employee was notified that he had been found
guilty and he was discharged from the service.
The Board has thoroughly reviewed the record and finds that
evidence supports the -Carrier's findings of guilt to the charges.
Under the facts of this record, which shows a serious offense has
been committed by the Claimant, the Board has no basis to set aside
the discipline assessed by the Carrier.
AWARD
The claim is denied.
