STATEMENT OF CLAIM: Appeal of B & B Mechanic J. Vizzachero to have
fifteen (15) days suspension removed.
FINDINGS: The Claimant was notified to attend an investigation on thefollowing charges: Failure to report to work location promptly; failure
to follow instructions from proper authorities and perform duties
efficiently and safely; failure to devote himself exclusively to the -
Company's service while on duty; insubordination and willful cli.sregard of the Company's interest in that worked was not performed
as prescribed-
Subsequent to the investigation, the Claimant was notified
that
he had
been found guilty and was suspended as noted above.
The Board has thoroughly reviewed the testimony adduced at
the hearing and other evidence of record before us. We find that
the Carrier had reasonable grounds to conclude that the Claimant
played a significant part in the events surrounding and leading
to the charges advanced by the Carrier. Under these circumstances,
we conclude that the Carrier's actions were not arbitrary or
capricious.
