PARTIES TO THE DISPUTE.

Brotherhood of Maintenance of Way Employes
and
Spokane, Portland and Seattle Railway Company (System Lines)

                    STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that:


      (1) The Carrier violated the Agreement when it required

      Noble Hawkins (Case No. MW-173), Edna Clugston (Case No.

      MW-185), Lurana M. Day (Case No. MW-186), Alva H. McNair

      (Case No- MW-187) and W. R. Wheeler (Case No. MW-189) to

      work during overtime hours, on holidays and on their rest

      days and then failed and refused to compensate them

      therefor.


      (2) The aforementioned claimants now be compensated at

      their time and one-half rates for the overtime service

      referred to in Part (1) of this claim."


FINDINGS

The Board, upon the whole record and all the evidence finds that:

In view of the facts and circumstances in this particular case and without construing the rules of agreement relied upon by the parties as they might apply to any other case involving the same or similiar set of circumstances, the following allowances ;gill be made to claimants-

          MW-173 Hawkins $ 38.30

          MW-185 Clugston 8.60

          MW-186 Day 8.60

          MW-187 McNair 53.00

          MT-189 Wheeler 162.00
