STATEMENT OF CLAIM: "Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the Agreement beginning
June 1, 1965 when it required Track Laborer
D. Green and Fire Patrolman L. Marshall to
suspend work from 8:00 A.M. to 9:00 A.M.
(2) Claimants Green and Marshall be allowed one
hour's pay at their respective time and one-half
rates for each assigned work day within the
period beginning June 1, 1965 and ending with the
date of
termination of
this
violation."
FINDINGS:
The Board,
upon
the whole record and all the evidence,
find that:
The rules relied upon, when applied to the facts of record,
do not support an affirmative award. Rule 30 (b) is 'controlling.
AWARD. Claim denied.
