STATEMENT OF CLAIM: Carrier violated Rule 26(b) by refusing to allow Arizona Division Track Foreman Tom Garcia to return to service after being released by his physician.
Carrier should be required to have Claimant Garcia re-examined in accordance with Rule 26(b) and paid for all wages lost from January 10, 1989, continuing until the Claimant is afforded his rights under said rule.
FINDINGS: The parties have requested that the case be withdrawn from the Board. The request is granted.
