STATEMENT OF CLAIM
Claim on behalf of M. S. Johnson for the pay difference between an extra gang foreman and ballast crew
foreman for 120 hours.
OPINION OF THE BOARD
Claimant M. S. Johnson bid and accepted a job as Foreman on
System Surfacing Crew No. 2. The task of the crew was to surface
track between mile post A-46.00 and A-57.00. 'During
the
course of
this work, the surfacing crew lifted some portion of the track fiveand-a-half inches. The Union contends that the lifting of track
five-and-a-half inches is more than just surfacing track and Claimant
should have been paid as a Ballast Crew Foreman a total of 73 cents
more an hour than he received.

This Board has reviewed the record and is not persuaded that
the claim has merit. Claimant bid a job as Foreman of a gang to
surface track and other work was designated. We are not of the
opinion that a distinction such as Claimant would have us draw is
appropriate in this case.
AWARD
The claim is denied.
