STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that:


  1. The Carrier violated the Agreement when it failed and refused to award Mr. A. Kiest an advertised welder position on Gang ICAQ HOl via bulletin dated September 6, 2012 (System File Cl22812/IC-BM\\'ED-2012-00089 ICE).


  2. As a consequence of the violation referred to in Part 1 above, Claimant A. Kiest is entitled to a seniority date of September 6, 2012 as a welder and he shall be compensated the difference between his welder helper rate of pay and the welder rate of pay from September 6, 2012 to November 23, 2012."


FINDINGS:


At the hearing of the Board in this case on July 26, 2016, this Board was infonned that the parties have decided to settle this matter and dismiss the case.
