STATEMENT OF CLAIM: “Claim of the System Committee of the Brotherhood that:

“We are hereby submitting claim/grievance in accordance with Rule 34 of the current Working Agreement between the Canadian National / Illinois Central Railroad (CN-IC) and its employees represented by the Brotherhood of Maintenance of Way Employees Division of the International Brotherhood of Teamsters (BMWED-IBT) on behalf of the below mentioned, or senior most qualified in the area employee’s, because the Carrier violated the Current Working Agreement including but not limited to, Rule(s) 2, 3, 8, 10, 14, 25 and 29 concerning the application of prevailing seniority.”

FINDINGS:

The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934. Public Law Board 6043 has jurisdiction over the parties and the dispute involved herein.

At hearing before the Board, the parties jointly advised that this claim has been settled on the property and requested an Award showing it was dismissed.

AWARD

Claim dismissed.
