“Claim of the System Committee of the Brotherhood that:
The Carrier violated the Agreement on November 14, 2015, when it improperly bulletined new positions with starting times outside the prescribed times allowed for by the Agreement and when it failed to notify the Organization of such changes and afford the Organization an opportunity for discussion (System File C 13 11 14/IC-BMWED-2013- 00291 ICE).
As a consequence of the violation referred to in Part 1 above, all Northern Seniority District employes shall now be ‘… compensated eight (8) hours straight time, plus any hours worked on these shifts be paid at the time and one half and double time rate if over eight (8) hours, and the jobs be abolished a (sic) bulletined within the time limits afforded by the CBA.’ (Employes’ Exhibit ‘A-1’).”
The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934. Public Law Board 6043 has jurisdiction over the parties and the dispute involved herein.
At a hearing before the Board, the parties jointly advised that this claim has been settled on the property and requested an Award showing it was dismissed.
Claim dismissed.
