“Claim of the System Committee of the Brotherhood that:
The Agreement was violated when, on March 3, 2013, the Carrier assigned welding gang employes to perform overtime work (fixing a rail pull apart and a broken rail) at Mile Posts 205 and 226 in Manchester, Iowa on the Iowa District, instead of the regularly assigned incumbents, Mr. J. Carlson and Mr. D. Penn (System File C130303/IC-BMWED- 2013-00115 ICE).
As a consequence of the violation referred to in Part 1 above, Claimants J. Carlson and D. Penn shall now be ‘… allowed a total of four (4) hours at his time and one-half rate totaling $336.44 and $305.50 for both claimants respectively’ (Emphasis in original) (Employes’ Exhibit ‘A-1’).”
The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934. Public Law Board 6043 has jurisdiction over the parties and the dispute involved herein.
At a hearing before the Board, the parties jointly advised that this claim has been settled on the property and requested an Award showing it was dismissed.
Claim dismissed.
