STATEMENT OF CLAIM:


“Claim of the System Committee of the Brotherhood that:


  1. The Agreement was violated when on June 8, 2014, the Carrier assigned employes from the Brookhaven, Mississippi section gang to perform rest day overtime service working on a rail loading project (Rail Train), instead of the regularly assigned incumbents, Messrs. C. Logan and P. Mauroner (System File C 14 06 08/IC-BMWED-2014-00145 ICE).


  2. As a consequence of the violation referred to in Part 1 above, Claimants

C. Logan and P. Mauroner shall now be ‘… allowed a total of eight (8) hours at their time and one half rate of pay for one (1) day totaling

$311.16 for claimant Logan and, $306.60 for claimant Mauroner.’ (Emphasis in original) (Employes’ Exhibit ‘A-3’).”


FINDINGS:


The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934. Public Law Board 6043 has jurisdiction over the parties and the dispute involved herein.


At a hearing before the Board, the parties jointly advised that this claim has been settled on the property and requested an Award showing it was dismissed.

Claim dismissed.
