“Claim of the System Committee of the Brotherhood that:
The Agreement was violated when on March 22, 2014, the Carrier failed to call and assign Messrs. J. Reeter and J. Bawinkel, who were both regularly assigned to positions on Section Gang 111 headquartered in Dubuque, Iowa and instead called and assigned the section foreman and the section welder who were headquartered in Manchester, Iowa, to repair a defective rail at Mile Post 202.1 near Dubuque, Iowa (System File C 14 03 22/IC-BMWED-2014-00056 ICE).
As a consequence of the violation referred to in Part 1 above, Claimants
J. Reeter and J. Bawinkel shall now be ‘… allowed a total of eight (8) hours at their time and one half rate of pay for one (1) day totaling
$311.16 for claimant Reeter and, $306.60 for claimant Bawinkel.’ (Emphasis in original) (Employes’ Exhibit ‘A-1’).”
The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934. Public Law Board 6043 has jurisdiction over the parties and the dispute involved herein.
At a hearing before the Board, the parties jointly advised that this claim has been settled on the property and requested an Award showing it was dismissed.
Claim dismissed.
