“Claim of the System Committee of the Brotherhood that:
The Carrier violated the Agreement when, on Saturday, August 14, 2010 and on Sunday, August 15, 2010, it allowed junior mobile employes to perform overtime work in the Geismar Yard, on the Baton Rouge District in Geismar, Louisiana rebuilding the lead hump tracks, instead of the senior mobile employes (System File A101012/IC-BMWED-2010- 00061 ICE).
As a consequence of the violation referred to in Part 1 above, Claimants
J. Murphy, S. Mitchell, R. Palmer, J. Daniels, M. Bailey, C. Dias and D. Clear shall now each be compensated for ‘… a total of thirty-two (32) hours at the time and one-half rate and sixteen (16) hours at the double time rate at their respective overtime rates of pay.’ (Employes’ Exhibit ‘A-1’).”
The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934. Public Law Board 6043 has jurisdiction over the parties and the dispute involved herein.
At a hearing before the Board, the parties jointly advised that this claim has been settled on the property and requested an Award showing it was dismissed.
Claim dismissed.
